Full Terms Of Service
Section I. Image Copyright
1. I, the artist, retain full and exclusive rights to the original artwork. The client may not claim the artwork as their own or use it for anything other than personal use.
2. All artwork commissioned is for noncommercial use only unless clearly stated otherwise. Redistribution of my artwork in printed merchandise or as a promotion of goods and services is completely prohibited. Any questions about this must be brought up before commissioning.
3. Reposting is allowed if credit is given. The client is not allowed to remove the artist's watermark or repost if no credit is given. Reposting with phrases similar to "Credit to the original artist" without stating the original artist by username is not allowed.
4. Prohibited Actions Include:
○ Altering my artwork in any way without written permission. Cropping and/or resizing for an icon or some other use is allowed.
○ Claiming the artwork as your own
○ Tracing over my artwork or repurposing parts of the artwork.
5. If any of these terms are broken, you will be put on a private blacklist and denied any further commissions from me.
Section II. Payment Information
1. I accept payment in USD only. Payment will be taken through PayPal, CashApp, or Kofi. Any exceptions may be discussed, but are not guaranteed.
2. You will be given 24 hours to pay after a sketch is shown or a quote is given. Lack of payment within this 24 hour period will result in the commission being cancelled and any progress made to be deleted.
3. It is the client's responsibility to let me know when the payment has been sent. If a payment falls through, or the client fails to inform me of a sent payment within 24 hours - and I am absolutely certain I have not received this payment - then the 24 hour payment term will apply to you.
4. Refund Policy:
○ If the commission is cancelled by either me or the client before work has been started, then a full refund will be given.
○ If the client cancels the commission during progress, the amount refunded will be on a case-to-case basis and is entirely up to the artist's discretion. Most commissions will fall into this rough basis:
• Sketch: 90%
• Lineart: 50%
• Lineart and Flat Color: 0%
○ No refunds will be given for completed or nearly completed commissions.
○ I, the artist, reserve the right to cancel any commission at any time, for any reason, and without any explanation.
○ If I cancel a commission due to my inability to complete it at any point, a full refund will be given.
Section III. Content and Communication
1. Discussion of commissions may be conducted via Discord (@curseofbirds), Tumblr PMs, or email.
2. Visual Reference Guidelines:
○ The client must provide at least one clear and concise visual reference. Any other important information should absolutely be included to allow me to complete the commission effectively.
○ Any reference images given should be given without shading to avoid color discrepancies between the reference and the commissioned artwork.
Section IV. Topics Allowed
1. Below is a general guideline for what topics I will and won't draw. Please note that I will not attempt to match another artist's or company's art style. My art style should be kept in mind when ordering.
2. Allowed Content:
○ Humans
○ Monsters
○ Furries
○ Gore
○ Ship Art
○ Semi-NSFW
⚠ NSFW (May affect payment)
⚠ Complicated Designs (May affect price)
3. Disallowed Content:
○ Characters intended to be or appearing underage in any suggestive or NSFW content whatsoever.
○ Mecha (Ask first)
○ Any sort of hateful content, including but not limited to racism, homophobia, transphobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.
4. You must be over the age of 18 to commission ANY adult content.
○ I am a United States citizen and I abide by United States laws. Breaking this rule is extremely serious and could lead to extreme consequences to both the client and myself as the artist. Any attempt to break this rule will result in blacklisting and blocking on all social media, email, and any other forms of contact. By ordering ANY NSFW content, you are agreeing that you are at or above the age of 18.
Section V. My Workflow Process
1. I work best with some artistic freedom. I am more than happy to match a pose or scene that you may have in mind, but please allow and expect at least a little variation.
2. Estimated date of completion may vary. Any delays in completion of the commission will be communicated to the client personally.
○ Completion of the most commissions is estimated to take roughly 1 to 2 weeks. If I cannot complete a commission within 90 days of ordering, I will issue a full refund.
3. Works In Progress (WIPs) Every commission will be given at least 1 WIP to make sure everything is acceptable to the client. Certain commissions are given more than 1 WIP to assure everything is going as planned. All progress will be paused until the WIP is confirmed.
4. Revisions and Edits The first WIP of a commission is allowed to have major revisions made. This includes changes in pose, body shape, or any other part of the sketch.
○ After the first WIP is approved,no major edits will be made. If any major revisions or edits are requested after the first WIP is approved, a price may be discussed.
○ If I, the artist, make any sort of error in the character design, background, or any other visual element that was specified in the order, I will make these edits with no additional cost.
5. If you do not want me to post your commission online, you must tell me when the order is placed. Any commissioned art posted by myself is used to advertise commissions, and will always credit the client.
